Terms and Conditions of Service

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and Selina Labs regarding your use of any product, service, or application powered by the Fold protocol, including but not limited to FoldSEND, FoldVAULT, Fold0, Selina.AI, and all related domains, subdomains, interfaces, and software (collectively, the "Services").

By accessing or using any Service in any manner, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Service Description

1.1 Overview

The Services provide encryption, compression, and tagging-based technologies for secure memory, file exchange, and related applications. Each product (e.g., SELINA.AI, FoldSEND, FoldVAULT, Fold0) operates on the Fold protocol, which is designed for secure, resilient, and user-directed data handling.

1.2 Underlying Technology

All Services operate on a protocol that encrypts and folds data into structured memory objects ("seeds"). Selina Labs does not retain unencrypted user data.

1.3 Account Requirement

Certain features require a registered and authenticated account. Some Services (such as receiving FoldSEND transfers) may be accessed without registration.

2. Service Tiers and Limitations

2.1 Service Tiers

Free and paid tiers may be offered with varying limits on file size, duration, storage, and features. Details are specified within each Service interface and may be updated from time to time.

2.2 Auto-Destruction and Retention

Files, seeds, or memory objects may automatically expire or be destroyed once preset limits are reached (e.g., time windows, download counts, storage thresholds).

2.3 Non-Guarantee of Delivery

Selina Labs does not guarantee successful delivery, storage, accessibility, or recall of any data, and is not liable for delays, corruption, or loss.

3. User Responsibilities and Prohibited Conduct

3.1 User Content

You are solely responsible for all files, data, and content you upload, store, share, or tag using the Services. You must ensure that your content is lawful and appropriate.

3.2 Prohibited Content

You may not use the Services to store, transmit, or process content that:

• Violates any applicable law or regulation;
• Contains malware, ransomware, or malicious code;
• Infringes intellectual property rights;
• Includes child sexual abuse material (CSAM) or other exploitative content;
• Is obscene, defamatory, harassing, or abusive;
• Promotes terrorism, fraud, or unlawful acts.

3.3 Prohibited Activities

You may not:

• Circumvent service limitations or security features;
• Interfere with or disrupt any Service or system;
• Use the Services to stalk, harm, or exploit others;
• Resell, sublicense, or lease the Services without written authorization.

3.4 Indemnification

You agree to defend, indemnify, and hold harmless Selina Labs and its affiliates against all claims, damages, and expenses arising from your use of the Services or violation of these Terms.

4. Privacy and Security

4.1 Encryption

All Services employ encryption before data is stored or transmitted. Selina Labs does not have access to decrypted user content.

4.2 Metadata

Limited metadata (e.g., file size, upload timestamp, expiration window, download count, tag indices) may be stored for functionality and billing. Metadata may be disclosed only as required by law.

4.3 Privacy Policy

Use of the Services is also governed by our Privacy Policy, which is incorporated herein by reference.

5. Payments and Billing

5.1 Subscription Fees

Paid Services require timely payment of applicable fees via Stripe or another approved payment processor.

5.2 Refund Policy

All subscription fees are non-refundable except where required by law. Selina Labs does not provide refunds or credits for partial subscription periods, unused features, or account suspension/termination.

5.3 Taxes

Users are responsible for all applicable taxes arising from their purchases or usage.

Selina Labs may, at its sole discretion, suspend or terminate any account, access, or feature at any time, with or without notice, for any reason, including but not limited to suspected abuse, security risks, violation of these Terms, or activities we reasonably believe could harm the Services, users, or third parties. Selina Labs is not required to provide proof of such activities to exercise these rights.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflicts of law. Selina Labs reserves the right to designate another jurisdiction if its corporate domicile changes.

10. Amendments

We may update these Terms at any time by posting a revised version on our website(s). Continued use of the Services after such changes constitutes acceptance of the revised Terms.

11. Service Availability and Discontinuation

Selina Labs reserves the right to modify, suspend, or discontinue any Service, feature, or the Services as a whole, at any time and without liability to you. In the event of a complete discontinuation of a paid Service, Selina Labs may, at its discretion, provide prorated refunds or alternative remedies, but is not obligated to do so except where required by law.
